WAIVER

PACIFIC MARTIAL ARTS FEDERATION USA INC.

(Also known as in this agreement: PMA, PMAF, PACIFIC MARTIAL ARTS and is made between the participant, student, volunteer

or anyone participating in any role or manner at the camp and the PMA.) 

This special form applies additionally to any PMA activity involving travel and does not delete nor nullify any terms of existing agreements made with the PMAF USA, Inc. and the student or parents who sign this agreement.

Karate is a physical activity.  Uncontrolled or careless contact such as  punching and kicking a partner is not permitted.  Members must realize that in spite of care, precaution, and concern, that accidental injury may occur by the very nature of the activity.  Using excessive force or showing disregard for the safety of others in training will result in dismissal. Any student who exhibits behavior, conduct or attitude considered detrimental to the PMA, its instructors and its students will be dismissed. Such exhibition is not limited to actions within the school confines. I hereby acknowledge and understand that karate is a physical activity with large risk element. Teachers and fellow students exhort students to push their limits physically and mentally. It is part of the self-development and challenge of karate. There it is also possible that serious injury can result through throws, falling, kicking, punching, blocking, weapon’s practice and other aspects of karate and martial arts training. The student assumes all risk. Such injuries and accidents can lead to serious conditions and results, including possible death. Such situations can be made even more serious if the trip involves locations distant from medical assistance. The PMA are not responsible for supplying medical help nor personnel on such trips. BE AWARE there is a definite risk of injury and accident and illness on a trip such as this that involves travel, possibly swimming, activities, hiking, sightseeing, karate training, etc. You are being asked to push yourself in a physical sense at the training. There could be insects, animals, poison ivy and other dangers common to outdoor camping. The weather can be both very hot and cold, and sleeping hours are reduced. Although the staff and volunteers will be trying to look after everyone's health and welfare they cannot be held responsible for accidents, injuries, exhaustion and any other unpleasant outcomes of attending a desert camp. Parents of minors agree to assume all these risks.

I hereby agree to indemnify and save harmless PMAF, Jerry Devine and his appointed instructors and volunteers against any and all liability, loss damages, costs, or expenses which they may incur or be required to pay as a result of my (or my son's or my daughter's) participation in the Pacific Martial Arts' activities.  I further agree not to make claim against any other person or corporation which mighty in turn make a claim against them.  I further understand that my fees/costs are fully due whether I participate or not for any reason during the trip. No refund will be made on any unused lessons or other aspects of the trip and the related events for any reason whatsoever.

In the case of medical emergency, the instructors may have to make a decision to commit the participant in duress to medical authorities. It may not be possible to contact relatives first for approval. Be sure to carry medical insurance information, medical information (example, are you diabetic), and emergency phone numbers with you. The latter should include both daytime, work time and evening numbers of at least two different households in your city.

 

In the case of minors participating, I (if a minor) and I (as a parent of said minor) realize that chaperoning will be of a  limited nature and on a voluntary basis by other participants of the trip. There may be times that the minor(s) will not be chaperoned. Minors are subject to the decision making of Jerry Devine and his other appointed instructors and volunteers on the trip. This will include requiring minors to travel in cars and other means of transportation. I absolve the PMAF, Jerry Devine and his instructors and appointed volunteers of all responsibility as a result of any outcomes of such decisions. Drivers of minors are similarly absolved.  The same releases and save harmless conditions will apply to all the participants of the PMA in relation to my participation and I do so hereby and voluntary agree to release and save them harmless as cited above.

 

Event: Winter camp Kangeiko, Feb. 3rd to 5th of 2012.  It is a very hot and cold area, temperatures in the seventy degree range down to low twenties. The altitude is about four thousand feet, high desert and mountain geography. Students are warned to drink lots of water. Any parent may ask questions of any type to reassure themselves of their children's safety and welfare and what they can be exposed to. Parents assume all risk of their children's welfare.  The prime teaching days of the camp are  Feb. 3, 4, and 5 but this waiver will cover the surrounding days (traveling to and from) since students are coming and going at different times. Dismissal time Sunday  the 5th is around 4 pm followed by a group dinner so return to San Diego will be later. Students may be sleeping on floors. Details of the camp and what to bring are widely distributed and posted both by email and on this web site. Please ask if you have questions. 

 

 

I have read the above and concur, understand, support and accept the guidelines and information. This agreement will also be considered to be in effect and valid for any future winter or summer camps in which I am a participant in the future and hosted by the PMA.
